Conflict and respect for legality in electoral processes

Abstract

Given the complexity that democratic systems in the world are going through, this conference shows three examples of how respect for legality in electoral processes has been violated in Mexico and how this situation has increased the judicialization of popular election processes. The first part deals with the improper use of economic resources to alter equity in electoral contests. The second part deals with the way in which political practices attempt to evade compliance with the law. Finally, the third part deals with the importance of respect for the autonomy of electoral authorities and particularly jurisdictional authorities for the proper functioning of democratic regimes.

Author Biography

Janine Otálora Malassis, Tribunal Electoral del Poder Judicial de la Federación, México.

Licenciada en Derecho por la Universidad Nacional Autónoma de México (UNAM). Cuenta con un diplomado en “Sociología política” por la Sorbona y es doctora en Ciencias Políticas por esa universidad. Ha realizado impor­tantes funciones académicas en la UNAM y en otras instituciones. Fue secre­taria técnica en el Consejo de la Judicatura Federal, así como magistrada presidenta de la Sala Regional Ciudad de México del Tribunal Electoral del Poder Judicial de la Federación (TEPJF). Tiene obras publicadas acerca de los sistemas judiciales en Francia y en México y la profesionalización de la po­lítica, así como distintos ensayos acerca de la democracia electoral y otras modalidades de participación política. En la actualidad es magistrada de la Sala Superior del TEPJF, donde fue magistrada presidenta.
